Terms of service

The terms you agree to when you order from Bazarche: how a contract is formed, what we charge, when we deliver and where you stand if something is wrong.

About these terms

These terms govern every order placed on bazarche.co.uk with Bazarche of 42 Grants Close, Mill Hill, London, NW7 1DD, United Kingdom. Placing an order means you accept them, so please read them before you check out. Nothing here takes away the rights the law gives you as a consumer.

Placing an order

Your order is an offer to buy. It is accepted, and a contract formed, only when we send you a dispatch confirmation email, not when you check out and not when your card is authorised. Until then we may decline the order, for example if an item has sold out, if it was listed at the wrong price, or if we cannot verify the delivery address.

Check your order confirmation as soon as it arrives. If anything on it is wrong, tell us the same day and we will amend it if the parcel has not left us.

Who can order

You must be 18 or over to place an order. Anyone younger must have a parent or guardian order for them.

Prices and payment

Prices are in pounds sterling and include VAT where it applies. Delivery is charged separately and shown in full before you pay. Payment is taken in full before your order is dispatched; we accept the cards shown at checkout, and payment is processed securely by our payment provider.

Prices can change, but never after we have accepted your order. If an item was listed at an obviously wrong price we will contact you before dispatching, and you can confirm at the correct price or cancel for a full refund. Any charge your own bank makes for the payment is yours; any charge our receiving bank makes is ours.

Delivery

We deliver throughout the United Kingdom by carrier to the address you give us. Delivery is free on orders over £34.99; below that the rate for the option you choose is shown at checkout. Orders placed before 2pm on a working day are dispatched the same day.

Delivery estimates are estimates. Where we cannot meet one, we will tell you, and if delivery has not happened within 30 days of our dispatch confirmation you may cancel and take a full refund. The parcel becomes your responsibility once it is delivered to the address you gave us.

Please give an address where somebody can take the parcel in. If an address is wrong or incomplete and the parcel comes back to us, we will refund the goods but not the cost of getting them there and back.

Changing your mind

Under the Consumer Contracts Regulations 2013 you may cancel most orders within 14 days of receiving them, without giving a reason, and return the goods within 14 days of telling us. Our refund policy sets out how, what is excluded, and who pays the return postage.

Food that spoils quickly, and sealed goods that are not suitable for return once opened for health or hygiene reasons, are excluded from this right by the Regulations themselves. That does not affect your rights if an item arrives damaged, out of date or not as described.

If something is wrong with your order

Tell us within 24 hours of delivery if an item arrives damaged, missing or incorrect, with a photograph if you can. It is the fastest route to a replacement or refund and it helps us take it up with the carrier.

Separately from that, the Consumer Rights Act 2015 gives you the right to goods that are of satisfactory quality, fit for purpose and as described. Nothing in these terms limits that right, and no time limit we set here shortens it.

Availability

Everything on the shop is subject to availability. Where an item you have ordered turns out to be out of stock we will contact you and refund it in full, or send the rest of the order and refund the difference, whichever you prefer.

Our responsibility to you

We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, and our liability for any order will not exceed the amount you paid for it.

We never exclude our liability for death or personal injury caused by our negligence, for fraud, for defective products under the Consumer Protection Act 1987, or for anything else the law does not allow us to exclude.

Bulk and trade orders

The shop is for household quantities. Orders above £4,000 in any month are treated as trade, may require AWRS registration and are subject to our due diligence checks; we may decline or cancel them. Write to us before placing one so we can set it up properly.

How we handle your personal information is set out in full in our privacy policy. Marketing email is opt-in only, and every message we send carries a one-click unsubscribe.

Governing law

These terms are governed by the law of England and Wales, and disputes may be brought in its courts. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.

We may update these terms; the version that applies to your order is the one published when you placed it. Questions about any of this go to [email protected].
